Introduction

Welcome to Hover The Horizon! These Terms and Conditions (“Terms”) govern your use of our drone photography and videography services. By booking our services, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Definitions

  • Client: The individual or entity booking services from Hover The Horizon.
  • Services: Aerial photography, videography, and related services provided by Hover The Horizon.
  • Operator: Licensed drone pilot employed or contracted by Hover The Horizon.
  • Deliverables: Photos, videos, and other media produced as part of the Services.

2. Booking and Payment

2.1 Booking Process

  • Bookings can be made via phone, email, or through our website.
  • A deposit may be required to secure the booking.

2.2 Payment Terms

  • Payment details, including deposit amounts, total fees, and payment deadlines, will be provided upon booking.
  • Final payment is due upon delivery of the final Deliverables unless otherwise agreed in writing.

3. Cancellation and Rescheduling

3.1 Cancellation Policy

  • Cancellations must be made in writing.
  • Cancellations made more than 7 days before the scheduled service date may receive a full refund of the deposit.
  • Cancellations made within 7 days of the scheduled service date may forfeit the deposit.

3.2 Rescheduling

  • Rescheduling requests must be made in writing at least 48 hours before the scheduled service date.
  • Rescheduling is subject to availability and may incur additional charges.

4. Weather and Safety

4.1 Weather Conditions

  • Drone operations are subject to weather conditions. If weather conditions are unsuitable, the Operator may reschedule the service at no additional cost to the Client.

4.2 Safety Protocols

  • The Operator reserves the right to cancel or reschedule services if safety concerns arise, including but not limited to inclement weather, restricted airspace, and technical issues.

5. Compliance and Permits

5.1 Legal Compliance

  • Hover The Horizon and its Operators comply with all relevant aviation laws, regulations, and guidelines.

5.2 Permits

  • It is the Client’s responsibility to obtain any necessary permits or permissions for drone operations at the location. Hover The Horizon can assist with this process upon request.

6. Deliverables and Revisions

6.1 Delivery Timeline

  • Deliverables will be provided within the agreed timeline, typically within 7-10 days after the service date.

6.2 Revisions

  • One round of revisions is included in the service fee. Additional revisions may incur extra charges.

7. Intellectual Property

7.1 Ownership

  • Hover The Horizon retains ownership of all raw footage and images.
  • The Client receives a license to use the final edited Deliverables for personal or commercial purposes as agreed.

7.2 Usage Rights

  • Hover The Horizon reserves the right to use Deliverables for promotional purposes unless otherwise agreed in writing.

8. Liability

8.1 Limitation of Liability

  • Hover The Horizon’s liability is limited to the amount paid by the Client for the Services. Hover The Horizon is not liable for any indirect, incidental, or consequential damages.

8.2 Force Majeure

  • Hover The Horizon is not liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of war, or government actions.

9. Client Responsibilities

9.1 Site Access

  • The Client must ensure safe and legal access to the site for drone operations.

9.2 Information and Cooperation

  • The Client must provide accurate information and cooperate with the Operator to ensure the successful completion of the Services.

10. Privacy and Confidentiality

10.1 Privacy Policy

  • Hover The Horizon collects and uses personal information in accordance with its Privacy Policy.

10.2 Confidentiality

  • Both parties agree to keep confidential any proprietary information disclosed during the course of the Services.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

12. Amendments

Hover The Horizon reserves the right to amend these Terms at any time. Clients will be notified of any significant changes.
